Privacy Policy & Terms and Conditions

Last updated: October 30, 2026

This page contains two separate documents for John W Thompson IV Photography LLC: our Privacy Policy, which explains how we handle information, and our Terms and Conditions, which govern use of our website. Both apply to www.jwtivphoto.com as described below.

Privacy Policy

1. Who We Are and What This Policy Covers

John W Thompson IV Photography LLC ("we," "us," or "our") operates www.jwtivphoto.com and provides photography services. This Privacy Policy covers information we collect through our website, inquiries, consultations, bookings, client communications, photography services, purchases, giveaways, and related business activities.

We primarily serve clients in the United States. Third-party websites and services linked from our website have their own privacy practices.

2. Information We Collect

Inquiries, subscriptions, and giveaways. When you contact us or complete a form, we may collect your name, email address, telephone number, preferred session timeframe, referral source, the name of someone who referred you, your reason for considering a session, and any other details you choose to provide. Newsletter signups and giveaway entries may also include contact details and information needed to administer the offer.

Client planning and services. When you become a client, we may collect your legal name, date of birth, mailing address, preferred contact method, scheduling preferences, music and styling preferences, features you would like to highlight, personal concerns, accessibility or physical limitations, allergies, food restrictions, comfort level with nudity, product interests, payment-plan preferences, and other information you voluntarily provide to help us plan your experience. Some of this information is particularly personal or sensitive. Please share only what you are comfortable providing and what is relevant to your session.

Contracts and payment records. We maintain contracts, questionnaires, image releases, invoices, authorizations, and purchase records. Square processes payments and stored payment methods. We do not intentionally store full payment-card numbers or card security codes in our own client records outside the payment processor. Payment-related documentation may contain limited details such as a cardholder's name, last four card digits, expiration date, or billing ZIP code.

Photographs and communications. We create and maintain original and edited photographs, image selections, album designs, proofs, and delivery records. We may retain emails, texts, social-media messages, consultation notes, and records of other business communications.

Website activity. When you visit our website, we and our technology providers may collect information such as IP address, approximate location, device and browser characteristics, pages viewed, referring websites, clicks, scrolls, other site interactions, and advertising or conversion information. Where enabled, analytics tools may generate website-session replays from page activity. These are not recordings made with your device camera or microphone.

3. How We Use Information

We use information to:

  • Respond to inquiries, arrange consultations, and communicate about potential bookings.
  • Plan, photograph, edit, deliver, and fulfill sessions, orders, and artwork.
  • Personalize hair and makeup, posing, wardrobe guidance, refreshments, and accessibility arrangements.
  • Prepare and administer contracts, releases, invoices, payments, and client records.
  • Send appointment, payment, order, delivery, and other service-related communications.
  • Send promotional emails when you have subscribed or otherwise authorized those communications.
  • Administer giveaways, verify entries, and contact winners.
  • Measure website performance, analyze advertising, improve our services, and protect against misuse.
  • Maintain business records, resolve disputes, protect legal rights, and comply with applicable law.

We do not sell or rent client contact lists for money or provide client photographs to unrelated businesses for their independent marketing. Website analytics and advertising technologies may nevertheless involve disclosures of online activity to technology providers, as explained in Section 6.

4. Photographs, Privacy, and Image Releases

Private unless authorized. We do not intentionally publish a client's private session photographs unless the applicable written agreement or model release authorizes that use. Depending on the arrangement, clients may be offered a full release, an anonymous-image release, or the option to decline a release. A release authorizing anonymous images does not guarantee that recognition is impossible; distinctive tattoos, jewelry, or other features may identify someone even when a face is not visible.

Your signed documents control. The scope, permitted uses, duration, and any withdrawal or removal provisions are determined by the applicable written photography agreement and image release, subject to law. A release may address portfolio displays, advertising, social media, professional competitions, educational materials, or other specified uses. Different arrangements may have different requirements.

Regular-price sessions and optional releases. When a client pays our regular session fee and image publication is optional, we may consider a written request to discontinue future use or remove photographs from channels we control, consistent with the signed agreement and law. This does not mean that all previously authorized uses are automatically revocable or that third-party copies can be retrieved.

Release-required discounted sessions and special opportunities. Certain model calls, special opportunities, trade arrangements, or discounted sessions require a signed image release as a material condition of participation. The discounted price or other stated benefit may be offered in consideration of specific image-use rights. If a participant later requests withdrawal of a release or removal of images, the applicable signed agreement may require repayment of the discount or other specifically identified consideration, to the extent permitted by law. For a reduced session fee, this may mean the difference between the regular session fee disclosed at booking and the discounted fee already paid, rather than an additional full session fee. The actual terms and amounts depend on the individual offer and agreement. A request to stop legally unauthorized publication, or removal otherwise required by law, will not be made conditional on paying a fee.

Requests to stop displaying images. You may contact us in writing about an image we have published. We will assess the request promptly based on the actual authorization, applicable agreement, and law, including any payment obligations that lawfully apply to release-required discounts. We can address content within our control where removal is agreed upon or required, but we may not be able to retrieve printed publications, previous third-party shares, screenshots, archived material, or copies outside our control.

Proofs and professional recognition. We may send sneak peeks by email or text. Album proofs may be shared using a Google Drive folder restricted to the client's email address. We may submit or display images for professional recognition only as allowed by the applicable release. Images included directly in our promotional emails are non-explicit; if an award-winning image contains nudity, we do not include an uncensored version in promotional email.

5. Editing Software and AI-Assisted Tools

We use professional photography and design software, including Capture One, Adobe products, AlbumStomp, and other editing, retouching, or organizational tools. Some features use artificial intelligence, including generative fill or automated retouching. Depending on the tool and feature, processing may occur on our devices or through a third-party service.

We handle client photographs through these tools for editing, production, and related business purposes, subject to our agreements and applicable law. Permission to display an image publicly is not, by itself, permission for unrelated AI uses. Where a proposed use requires additional authorization, we will obtain it before proceeding.

We do not intentionally submit client photographs for public AI-model training or authorize vendors to use them for unrelated marketing. Where available, we use relevant privacy settings and training restrictions. Third-party providers maintain their own systems and policies, so we do not claim control over every aspect of their processing.

6. Service Providers and Information Sharing

Depending on the services you use, we may share information reasonably necessary for the work with providers such as:

  • 17hats: inquiry forms, client records, contracts, questionnaires, workflows, and client portal.
  • Square: payment processing, saved payment methods, invoices, and transaction records.
  • Google Workspace and Google Drive: email, documents, and restricted proof sharing.
  • Adobe, Capture One, AlbumStomp, and professional retouching tools: image editing and album preparation.
  • The Boudoir Album, Miller's Lab, Image 3D, McKenna Pro, and comparable professional laboratories: printing and artwork production.
  • Analytics and advertising providers: tools such as Google Analytics, Google Ads, and Microsoft Clarity for website measurement, advertising performance, and conversion attribution. Google Search Console helps us review search performance. When enabled, advertising or measurement tools may also be provided by Meta (including Facebook and Instagram), TikTok, Pinterest, and other social-media, advertising, or analytics platforms.
  • Wheel of Names: randomized giveaway selections using entrant names.
  • Website hosting, security, backup, marketing, shipping, and other service providers as needed for ordinary business operations.

Artwork vendors ordinarily receive the identifying information necessary to process an order rather than a client's entire contact record. Products are generally shipped to our studio for inspection. If an order is shipped to you, the information needed to arrange delivery may be shared with the carrier or fulfillment provider.

We may also disclose information when required by law or valid legal process, to protect safety or legal rights, to investigate misuse, or in connection with a sale or reorganization of our business, subject to applicable obligations.

7. Cookies, Analytics, and Advertising

Our website may use cookies, pixels, tags, conversion APIs, and similar technologies for essential functionality, security, analytics, advertising attribution, audience measurement, and conversion tracking. Depending on which features are active, these technologies may be provided by Google, Microsoft, Meta (Facebook and Instagram), TikTok, Pinterest, or other advertising, social-media, and analytics services. We may add, remove, or change providers over time; references to a provider do not mean that every integration is active at all times. Our contact forms may also use security technology such as reCAPTCHA.

When enabled, tools such as Microsoft Clarity may help us understand website interactions through aggregate reports and session replays. We do not intentionally use session-replay tools to collect sensitive questionnaire responses or payment-card details. Sensitive fields should be masked or excluded through configuration, but no technical setting guarantees complete exclusion.

Advertising and analytics providers may receive identifiers, website activity, referrals, and conversion information. Some providers may associate that activity with other information according to their own policies, available settings, and applicable law. These technologies are not intended to transmit private session photographs, responses about nudity or body-related concerns, model-release decisions, or payment-card details to advertising networks. We aim to exclude sensitive form inputs and sensitive page or URL information from advertising events and tracking.

Depending on applicable law and the technologies in use, some transfers of online-activity data may be considered a "sale," "sharing," or processing for targeted advertising even if no money is exchanged. Where required by law or applicable provider rules, we will seek consent or offer opt-out choices for nonessential technologies. If a Privacy Choices control is available on our website, it can be used to review the choices it offers; browser and device privacy settings may provide additional controls. We will honor legally applicable privacy requests and preference signals where required. Blocking tracking may affect some functionality or measurement. We will update this policy when material changes to our data practices require it.

8. Email, Text Messages, and Social Media

Inquiries and client messages. If you contact us, we may respond and follow up about that inquiry. You can ask us to stop nonessential inquiry follow-ups. If you book or purchase from us, we may still send necessary communications about planning, payments, contracts, appointments, delivery, and support.

Promotional email. We send newsletters, special offers, studio updates, and similar marketing messages to people on our marketing list. These emails are currently managed through Google Workspace. Each marketing email provides a way to unsubscribe, and we honor opt-out requests within the period required by law. If available, our Email Preferences form also allows you to request that we stop promotional email, open-inquiry follow-ups, or both. Unsubscribing from marketing does not automatically stop necessary transactional or service messages.

Texts and social media. We do not currently conduct promotional text-message campaigns. We may use texts or social-media messages to respond to questions and communicate about inquiries and client services. We commonly direct social-media inquiries to our contact form and may retain relevant correspondence as business records.

Submitting an ordinary contact form does not, by itself, enroll you in unrelated promotional emails.

9. How Long We Keep Information

Retention varies by record type and contractual, operational, and legal needs:

  • Photographs: Original and edited files are generally retained for approximately one year after a session, unless a different arrangement or legal need applies. This is not a guarantee of file availability for that entire period.
  • Proofs: Restricted Google Drive proof folders are temporary and may be removed after client review or approval.
  • Contracts and permissions: Signed agreements, model releases, questionnaires, and related records may be retained long term, including indefinitely when needed to document rights, obligations, or the business relationship.
  • Payments and accounting: Invoices and payment records are maintained for business, tax, legal, and provider requirements. Square may retain transaction information under its own policies.
  • Communications: Email, text, and social-media correspondence may be kept long term, including indefinitely when relevant to service history or disputes.
  • Giveaways and marketing: Giveaway entries and winner records may be retained for administration and business records. Marketing-list details are retained until unsubscribed, removed, or no longer needed, although limited suppression records may be kept to honor opt-outs.

We may retain information longer when reasonably required for an agreement, legal claim, dispute, fraud prevention, tax obligation, or other legitimate purpose. Deletion from active systems may not immediately remove all backup or provider-held copies.

10. Information Security

We use reasonable administrative, physical, and technical safeguards appropriate to our operations, including restricting access to business records, protecting devices and accounts, encrypting backup drives where used, and limiting access to shared client proofs.

No electronic storage system or communication method is completely secure. Where notification of a data-security incident is legally required, we will provide it in accordance with applicable law.

11. Your Privacy Choices and Requests

You may contact us to request correction of inaccurate contact information, changes to communication preferences, or deletion of information or photographs we still control. Requests involving permanent deletion of client photographs should be made by email and may require identity verification and written confirmation of the exact files involved, because deletion may be irreversible.

We may need to retain certain documents or information to preserve contracts, model releases, transaction records, legal claims, or other records as permitted or required by law. Requests to remove photographs from public display are also subject to the applicable agreement, release, and law.

Depending on where you live and which laws apply to our business, you may have additional rights regarding access, correction, deletion, or the use of your information for targeted advertising. We will respond to applicable requests within legally required timeframes and will not unlawfully discriminate against anyone for exercising a protected privacy right.

To submit a privacy request, email john@jwtivphoto.com. We may ask for reasonable information to verify your identity or locate your records.

12. Age Restrictions

Boudoir sessions are strictly for adults age 18 or older. We may provide non-boudoir photography to minors, such as acting headshots, with the involvement and signed authorization of a parent or legal guardian.

Our general website and inquiry forms are not directed toward children, and we do not knowingly solicit personal information from children through those forms. If you believe a child has submitted information without appropriate permission, please contact us.

13. Updates and Contact Information

We may revise this Privacy Policy as our services, providers, or practices change. We will update the date at the top of this page when revisions are published and provide additional notice when required by law.

Terms and Conditions

1. Website Terms and Acceptance

These Terms and Conditions apply to the website operated by John W Thompson IV Photography LLC at www.jwtivphoto.com. By using the website, you are subject to these terms to the extent enforceable under applicable law. Where an affirmative agreement is required, we may ask you to accept the relevant terms separately.

Our website provides information about our photography services, portfolio, products, promotions, and ways to contact our studio. These website terms are separate from the contracts governing booked photography services.

2. Permitted Website Use

You agree to use the website lawfully and not to interfere with its operation or security. You may not:

  • Attempt unauthorized access to the website, servers, or related systems.
  • Introduce malware or other harmful code.
  • Scrape or systematically harvest website content through automated means without authorization, except as permitted by law.
  • Submit fraudulent inquiries or deliberately misrepresent your identity.
  • Use the website to infringe intellectual property, privacy, or other rights.

We may restrict misuse of the website to protect its security, our clients, and our business, consistent with applicable law.

3. Copyright and Intellectual Property

Unless otherwise noted, photographs, videos, written material, graphics, designs, logos, and other original website content are owned by John W Thompson IV Photography LLC or displayed with permission from the rights holder. Applicable copyright, trademark, and other laws protect this material.

Viewing the website does not grant a license to use its photographs or other protected content. Except with written permission or where legally allowed, you may not:

  • Download, reproduce, redistribute, publish, sell, or commercially exploit protected materials.
  • Use our images in another business's marketing, portfolio, or advertising.
  • Remove or alter watermarks, copyright notices, or identifying credits.
  • Present our photographs or other original work as your own.
  • Use our images to create unauthorized AI training datasets, train AI models, or produce unauthorized derivative images.

Purchasing an image, print, album, or other product does not automatically transfer copyright. Rights granted to clients are described in their individual agreements or licenses.

4. Client Image Privacy and Release-Required Opportunities

The presence of an image on our website does not authorize anyone else to copy, publish, manipulate, or distribute it. Our own permission to use client images is determined by the applicable written client agreement and release, not by these website terms.

Some discounted sessions and special opportunities are expressly conditioned on signing an image release. A participant's request to withdraw that release or remove images may have consequences specified in the signed agreement, including repayment of an identified discount where lawful. These website terms do not create a new fee or independently authorize publication, and no contractual repayment provision overrides rights or removal obligations established by law. See Section 4 of the Privacy Policy above for more information. Please contact us if you have a concern about an image depicting you.

5. Inquiries, Consultations, and Bookings

Submitting an inquiry, completing a contact form, or participating in a consultation does not by itself reserve a session date or establish a confirmed photography booking.

Bookings are subject to availability, our acceptance, and completion of the applicable requirements, which may include a signed agreement and payment of a session fee. A booking is confirmed only when we communicate confirmation after those requirements are satisfied.

We may decline booking requests as permitted by law.

6. Pricing, Promotions, and Special Opportunities

We may offer promotional session fees, discounts, limited-availability sessions, model calls, or other special opportunities. Some offers require a written image release as a condition of receiving the special price. Unless an offer expressly states otherwise:

  • Offers are subject to the advertised terms, eligibility, availability, and expiration dates.
  • A session fee includes only the services specified in the offer.
  • Images, albums, wall art, digital files, and other products are purchased separately unless expressly included.
  • Discounts cannot be combined unless the applicable offer allows it.
  • An inquiry alone does not secure a date, lock in a promotional offer, or guarantee acceptance into a special opportunity.
  • When an image release is required in exchange for a discount, the applicable written offer and signed client agreement explain any consequences of requesting release withdrawal or image removal, including any lawful obligation to repay the discount.

We may change future prices and offers, correct genuine errors, and discontinue promotions prospectively, subject to law. We will not use changes to website pricing to override an existing executed agreement.

7. Client Agreements and Purchases

Confirmed photography services and purchases are governed by the applicable signed photography agreement, invoices, payment-plan arrangements, and other written purchasing terms. Those documents address such matters as fees, cancellations, rescheduling, refunds, delivery, product orders, and image usage rights.

If a website term conflicts with a signed client agreement concerning photography services, the signed agreement controls for those services, subject to applicable law. Information on the website is not a promise of availability on a particular date.

8. Privacy and Communications

Our Privacy Policy above on this same page explains what personal information we collect, how we use and share it, and how to contact us about privacy requests.

You may subscribe to marketing messages through designated signup forms and may unsubscribe as explained in our Privacy Policy and individual emails. An inquiry is not automatically a newsletter subscription. Service-related communications may continue when necessary to fulfill an inquiry, booking, or purchase, as permitted by law.

9. Third-Party Websites and Links

Our website may link to social platforms, payment services, vendors, professional organizations, or other third parties. We do not control the independent content, availability, or privacy practices of those websites, and a link does not necessarily imply endorsement.

You may link to publicly available pages on our website so long as doing so does not misleadingly imply our sponsorship or endorsement. You may not use our logo, photographs, or other protected material for that purpose without appropriate permission.

10. Website Accuracy and Availability

We make reasonable efforts to provide accurate information but cannot guarantee that every page will always be current, uninterrupted, secure, or error-free. Content, functionality, and future offerings may be updated or discontinued.

Please contact us to verify current availability and applicable offer details before making a booking decision.

11. Website Disclaimer and Liability

To the fullest extent permitted by law, this website and its content are provided on an "as is" and "as available" basis, without warranties that access will be uninterrupted or that all content will be error-free.

To the fullest extent permitted by applicable law, John W Thompson IV Photography LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to access, this website, including outages and technical errors.

Nothing in these terms limits liability or consumer rights that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury where applicable. These website provisions do not replace obligations or remedies under a signed photography agreement or applicable law.

12. Governing Law

These website terms are governed by applicable federal law and the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes relating to these website terms may be brought in courts with appropriate jurisdiction in Pennsylvania, except where applicable law requires otherwise. Nothing here waives rights that cannot lawfully be waived.

13. Changes and Severability

We may revise these website terms and post an updated date at the top of this page. Revisions generally apply to future website use and do not automatically change separately executed agreements. If any provision is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.
